Terms of Service

1. Agreement and Operator
These Terms of Service are an agreement between you and Tinvo, the operator of the Tinvo app ("Tinvo," "we," or "us"). By creating an account or using the app, you accept these Terms. If you do not agree, do not use the app. Our Privacy Policy explains how personal information is handled.
2. Eligibility
You must be at least 13 years old to use Tinvo. If you are below the age of majority where you live, you must have a parent or legal guardian's permission to use the app and make purchases.
3. The Service and License
Tinvo helps collectors document vintage biscuit tins. You can record photographs of a tin's lithographed lid, base stamp, seams and interior; note its brand, dimensions, shelf location and lid fit; and revisit dated condition records. Tinvo does not authenticate, appraise or physically inspect any item.
Subject to these Terms, Tinvo grants you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes on Apple-branded products you own or control, as permitted by the Apple Media Services Usage Rules, including applicable Family Sharing or volume-purchase rights. The app is licensed, not sold. All rights not expressly granted remain with Tinvo or its licensors.
4. Accounts
Registration and sign-in
You need an account to use Tinvo. Register with an email address and password, then sign in with those credentials. Keep your password confidential and notify us at Tinvo@gmail.com if you suspect unauthorized access. You are responsible for activity under your account unless applicable law says otherwise.
Storage and deletion
Account details and your tin photographs, notes, condition cards, inspection history and coin balance are recorded and stored on our servers so they remain available when you sign in. You can manage or remove individual tin records in the app. To close your account and request deletion of associated data, use the Delete Account control in account settings or email Tinvo@gmail.com from your registered address. We will verify the request, delete or de-identify account data within a reasonable time, and retain only information required for legal, security or accounting obligations. Deleting the app alone does not close your account.
5. Acceptable Use
You must use Tinvo lawfully and respect others' rights. You may not:
- reverse engineer, decompile or bypass the app's technical restrictions, except where the law expressly permits it;
- resell the app or its services, transfer your account, or use automated means to abuse the service;
- attack, overload, probe or interfere with our systems or other users' access;
- upload unlawful, infringing, deceptive or harmful material, or material you lack the right to use; or
- harass anyone, impersonate another person, or misrepresent the source of content or an item.
6. Your Content
You retain your rights in photographs, notes and other content you submit. You grant Tinvo a limited, non-exclusive permission to host, store, reproduce, process and display that content only as needed to operate your account, provide your requested features, protect the service and meet legal duties. You must have the rights and permissions needed to submit your content.
7. Purchases
The first seven guided condition cards are free. After that, each condition card uses 28 coins. Coin packs, if offered, are purchased through Apple's in-app purchase system. Coins have no cash value, cannot be transferred outside Tinvo, and are consumed when you create a condition card. We may change future coin pricing with notice in the app; a change will not increase the cost of a condition card already completed.
This app does not offer any subscription, recurring payment, or auto-renewing service. All purchases are one-time consumable in-app purchases.
Apple processes payment and handles refund requests under the applicable App Store policies. Your statutory refund or consumer rights remain unaffected. Deleting an account may remove access to unused coins unless applicable law requires otherwise.
8. Intellectual Property and Copyright Complaints
The Tinvo app, interface, software, text and branding are owned by Tinvo or its licensors and protected by applicable intellectual-property law. These Terms do not give you ownership of them. Your own content remains yours as described above.
If you believe content in Tinvo infringes your copyright, email Tinvo@gmail.com with your name and contact information, identification of the copyrighted work, the location of the allegedly infringing material in the app, a good-faith statement that the use is unauthorized, and your physical or electronic signature. We may request more information to assess the notice.
9. Third-Party Services
Apple provides App Store distribution and in-app purchase processing. Apple's terms and privacy practices apply when you use its services. You must comply with applicable third-party terms. Tinvo is not responsible for independent third-party services or outages, except where applicable law makes Tinvo responsible.
10. Termination
You may stop using Tinvo at any time and may close your account as described in Section 4. We may suspend or terminate access if you materially breach these Terms, misuse the service, or create a security or legal risk. Where appropriate, we will provide notice and an opportunity to address the issue. On termination, your license ends and account data is handled under our Privacy Policy and legal retention duties. Sections concerning content rights and responsibility, purchases, intellectual property, disclaimers, liability, indemnification, disputes and general terms survive as far as applicable.
11. Disclaimers
To the extent permitted by law, Tinvo is provided "AS IS" and "AS AVAILABLE," without warranties of uninterrupted availability or error-free operation. Tinvo cannot guarantee that a photograph reveals every defect or that a recorded observation reflects the physical condition of a tin. Nothing in these Terms excludes a warranty that cannot lawfully be excluded.
12. Limitation of Liability
To the maximum extent permitted by law, Tinvo is not liable for indirect, incidental, special, consequential or punitive losses, including lost data or profits. Tinvo's total liability arising from the app or these Terms will not exceed the greater of the amount you paid for Tinvo during the 12 months before the event giving rise to the claim or US$50. These limits do not apply where law prohibits them and do not affect mandatory consumer rights or liability that cannot legally be limited.
13. Indemnification
To the extent permitted by applicable law, you will defend and indemnify Tinvo against third-party claims, losses and reasonable costs arising from your breach of these Terms, your unlawful use of the app, or content you submit that infringes another person's rights. This does not require you to indemnify Tinvo for its own wrongdoing.
14. Governing Law and Disputes
Before filing a claim, email Tinvo@gmail.com describing the issue; both sides will try in good faith to resolve it for 30 days. If unresolved, the laws applicable to your relationship with Tinvo govern these Terms, and either party may bring a claim before a court with jurisdiction under those laws. Nothing here deprives you of mandatory consumer protections or access to a court available under the law of your place of residence. These Terms do not require arbitration.
15. Apple App Store Terms
- These Terms are between you and Tinvo only, not Apple. Tinvo, not Apple, is responsible for the app and its content.
- Tinvo is responsible for any maintenance and support required by these Terms or law. Apple has no obligation to provide maintenance or support.
- For any failure to meet an applicable warranty, you may notify Apple and Apple may refund the purchase price paid for the app, if any. To the maximum extent permitted by law, Apple has no further warranty obligation; Tinvo handles other resulting claims.
- Tinvo, not Apple, addresses claims about the app or its use, including product liability, legal or regulatory compliance, privacy and consumer protection claims.
- Tinvo is responsible for investigating, defending, settling and discharging third-party claims that the app or its use infringes intellectual-property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a terrorist-supporting country, and are not on a U.S. Government prohibited or restricted-party list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you after you accept them.
16. Changes to These Terms
We may update these Terms as the app or applicable requirements change. We will change the Last updated date and give notice in the app of material changes before they take effect. Continued use after the effective date of an update means you accept the revised Terms, to the extent permitted by law. If you do not agree, you may stop using Tinvo and close your account.
17. General
If any provision is unenforceable, the remaining provisions continue in effect. These Terms and the Privacy Policy form the entire agreement about Tinvo, except for rights that cannot be excluded by law. A failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our consent; Tinvo may assign them to a successor that assumes the same obligations, subject to applicable law.
